Who Killed Arushi ?






One of India's most sensational criminal trials - which has raised issues of police incompetence, sex with servants and shady media ethics - comes to a close Monday, 25th Nov when a dentist couple will learn if they are to be convicted of killing their daughter.

The saga began on a baking 45-degree (113 Fahrenheit) May morning five years ago when thirteen years old Aarushi was found dead on her bed at home, covered with a white blanket. Their parents living next room had no clue what happened last night. Police initially called it an "open and shut case", blaming the missing Nepalese servant for the murder - only to discover his badly decomposed body on the roof a day later. 

For next five years it was win win situation for Media houses which got an all time breaking news when ever there was any new findings, court trail, no one even Modi couldn’t give them that much TRP . Media houses proclaimed their own judgments, Some media personal made their career out of this. One example is now well known Shoma Choudhary of Tehelka who have been covering the story since then and often found soft on Tahwar’s side  who states in her article

“Until the intervening night of 15 and 16 May 2008, the Talwars were just an ordinary middle-class Indian family. Rajesh and Nupur Talwar were dentists; their 13-year old daughter Aarushi was a pretty, vivacious grade 9 student in Delhi Public School (DPS), Noida. ” - Full Story here.

Well Soma, You have failed again like you failed in case of Tarun Tejpal disclosure. You failed the journalism once again. Who doesn’t know that Rajesh and Nupur Talwar were much influential people not Middle Class !, They were well known dentist duo of many UP politicians including then chief minister Mayawati . Mango people don’t get CBI probe for five years, High class people does.

It seems only God knows what happened, but God been on other side and rest of the investigators – our great CBI don’t have any clue so they are basing the case on the "last-seen theory" - which holds that the victims were last seen with the accused. If Hemraj’s body was not found, the case had been well closed now and lots of innocent Nepalese staying in India would have to pay the price for it. They would have be seen with suspicion and treated worse.

Hemraj’s phone was found some 200 kms away, but police again couldn’t get anything out of it. It suddenly looked like a badly scripted Ram Gopal Verma movie where audiences were harassed without any reason. Why he didn’t offer to make a movie in this topic if still not known. May be he is waiting for the judgment to come.

The shambolic probe - investigators failed to seal the scene of the crime allowing journalists to enter the house, or find the second body for 24 hours - prompted police to shut the case in 2010 citing no substantial evidence.
The Talwars then insisted they wanted the killers found and petitioned the court to reopen the case but they were then to find themselves charged with the murder.

And then media and court trail went on. The biggest murder mystery after Netaji Subhash Chandra Bose.

I feel bad for Arushi, not only she died in vain, she never got the justice. Whatever be the judgment tomorrow, it will be far from truth and based on just “assumption”.

The case could be an eye opener for Indian mass, the judicial system and the Police but aha It was mere waste of man force and money, they rather could enjoy one more match of Sachin- that what we Indians can do well after all.


We all failed her, and countless other victims who never got justice.  Hope after tomorrow when the case finally closes, Indian Media will give your soul some rest and whole India will forget you. But you will be deep inside your friend’s heart always.

If you look at Arun Kumar's investigation closely, it is hard to believe that someone in his team was not working for Talwars. Consider the following points -

1. The servants' lawyer gave video recordings of their narco tests to NHRC. These recordings clearly show that the first CBI team was putting words in the servants' mouth when they were intoxicated with this so-called 'truth serum'.

2. One of the servants (Raj Kumar) lived in another party of the city (20 min by bicycle ride). The watchman of his colony did not see him leaving the house. There were SIX watchmen guarding Jalvayu Vihar (Talwar's colony) but none of them saw any outsider entering or leaving the Talwars building.

3. The other two servants - Krishna and Vijay have evidence from their landlords (KN Johri and Puneesh Tandon respectively) that they were present in their landlords houses on the night. KN Johri and Puneesh Tandon (neighbour of Rajesh Talwar) are both respectable citizens from upper class. Why would they lie to protect low-class servants?

4. No DNA or fingerprints belonging to the servants (other than Hemraj) was found in Aarushi's house! The Talwars say that three glasses were found in Hemraj's room which is proof that three people were present. But given the fact that these bottles don't have any DNA/fingerprints of the servants (not even Hemraj!), it could be possible that they were planted by the Talwars themselves.

5. There was report that Hemraj's blood was found on Krishna's pillow, but the forensic lab (CDFD Hyderabad) itself clarified that there was a mix up error in the report - the pillow tested was taken from Hemraj's room not from Krishna's house.

6. Even just a week after the murders, the forensic scientists pointed out that the neck slit wounds displayed a clinical precision - both Aarushi and Hemraj's neck wounds were identical and had been made at the exact spot to cut the windpipe and dissect the left common carotid artery. The servants did not have such medical knowledge, but the Talwars studied surgery during their dental education (confirmed by faculty of Maulana Azad Medical College to CBI). Arun Kumar's team later forced the experts to say that the wounds were made by the Nepalese Khukri (which is too rough to make such precise fine cuts). When second CBI team went back to the original theory, Talwars lawyers claimed that they were changing statements - while in fact it was the first CBI team that had changed statements!

It might be possible that the parents are PROBABLY innocent, but the servants are DEFINITELY innocent.

Second CBI team has done a good job by exonerating the servants. They named Rajesh Talwar as the sole suspect but recommended closing the case because there was only circumstantial evidence against him. It's just that the judge refused to close the case and asked CBI to charge Talwars, so they HAD to produce some evidence against the Rajesh and Nupur.

The supporters of Rajesh and Nupur Talwar are making such a ridiculous argument that the CBI is framing rich Indians like Talwars to protect poor Nepali servants. Why would CBI do that?

Aarushi's relatives like Shree Paradkar are themselves journalists, and it seems that they are influencing other journalists. None of the stories being written about Aarushi murder case talk about the following facts which made the Talwars main suspects in first place -

1. When police asked Rajesh for the terrace key on May 16, he simply ignored them, went inside his room and did not come outside for hours. This has been testified by Rajesh's own friend and colleague Rohit Kochhar. Hemraj's body was found on the terrace later.

2. Retd officer KK Gautam has testified that he was asked to find a way to remove any possible mention of 's_ex' or 'r_ape' from Aarushi's post-mortem report. Sushil Chaudhary, a friend of Dinesh Talwar (brother of Rajesh) made this request. The mobile records of all three people show that Dinesh called Sushil, Sushil called KK Gautam - then these calls happeneed in the reverse order - MULTIPLE times on the day. There is strong evidence that Aarushi's private part was cleaned - even if we ignore the autopsy doctor's statement on the basis that it was made 2 years after the murder, there was evidence in form of a wet spot on the bdsheet under Aarushi's pelvic area, but there was no sign of any liquid on her clothes.

3. A whitish discharge was found in Aarushi's private parts during the post-mortem. When it was sent for testing, the doctor Ritcha Saxena (a friend of Nupur Talwar) concluded that it was not se_men. But when CBI's forensic scentists tried to verify it, they found the sample had been tampered with. Two labs (CFSL Delh iand CDFD Hyderabad) tested it. CFSL stated that the sample was a mix of samples from different persons. CDFD said that the sample did not have Aarushi's DNA at all! In spite of this, Arun Kumar hushed up the entire episode, saying that there was no tampering - the sample had become 'contaminated' on its own!

4. Hemraj's wife has said that when he called her last time, he told her that Rajesh had threatened him not to talk about his internal family affairs outside. A social worker Usha Thakur has also said that five days before his murder, Hemraj came to her and told her that he feared for his life - she could not talk to him because she was going outside the city at that time.

5. Rajesh told police to stop wasting time in his house and go searching for Hemraj in Nepal. What problem did he have with police trying to check the crime scene?

6. Why would any outsider try to hide Hemraj's body but not Aarushi's body? Even if he was killed on terrace, Hemraj's body had been dragged 20 feet and hidden behind a cooler panel. Then the terrace grill was covered with a bedsheet to avoid someone from the neighbouring terrace to see it. It's evident that the killer wanted to tell the police 'Hemraj killed Aarushi and ran away'.

7. Too many 'conincidences' happened on the same day.

[a] Nupur left the key to Aarushi's room hanging in the door by mistake.

[b] Aarushi's mobile was last used at 9:10 pm although previous days records show that she continued to chat with her friends after 12 pm. The killers took her simple Nokia mobile with them but did not steal any expensive item!

[c] Aarushi's friend Anmol called her at midnight. When she did not pick up the phone, he called her on landline (which is kept in Rajesh & Nupur's room) but there was no answer! Nupur's phone was switched off from 7:40 pm onwards although the mobile company records show that it had not been switched off even once in past 60 days!

[d] Both air conditioners were on in full power so Talwars did not hear any noise although Aarushi's bed was located just 8 feet away from them.

[e] Rajesh could not identify Hemraj's body because it was 'decomposed'... ok but he could not identify even the clothes on the body (a very distinct 'I Love New York' t-shirt)!

[f] The killers apparently did not become afraid and run away after killing Aarushi and Hemraj. They sat in Talwars house and drank whisky AFTER the murders (the bottle had blood marks of both victims). Apparently they also had the time and the daring to stay behind clear EVERY single fingerprint, shoeprint, DNA, blood etc. while the Talwars were sleeping in the adjacent room!

[g] The killers left the key to Aarushi's room in the living room, but ran away with the key to the terrace (where Hemraj's body was missing)

Now there is some evidence in support of the Talwars too (e.g. shoeprint with size 8-9 on terrace, the whisky bottle was not hidden etc.) but these are all easily refutable (e.g shoeprint was deliberately imprinted to mislead investigators, they simply forgot to hide the whisky bottle - no killer is perfect etc.) Whatever the case, the SERVANTS ARE DEFINITELY INNOCENT - they were being framed by the first CBI team under Arun Kumar. The present CBI team gave them justice. If Rajesh wears size 6, so do the servants - they don't wear size 8-9 shoes either! Their fingerprints were not found on the whisky bottle either!
